Abstract

Scientific and technological advancements in human reproduction have transformed reproductive medicine globally, yet Nigeria lacks comprehensive legal frameworks to regulate these developments. This study examines the legal implications of reproductive technologies, including contraceptive methods and Assisted Reproductive Technologies (ART), within the Nigerian legal context, analyzing the constraints and dangers of unregulated access to various contraceptive methods and assisted reproductive techniques. This research adopts a doctrinal legal analysis approach, examining existing Nigerian statutes, international human rights instruments, and comparative legal frameworks from other jurisdictions with established reproductive rights legislation. The analysis reveals significant legal lacunae in Nigeria's regulatory framework for reproductive technologies. Current legislation, primarily the Criminal Code Act and Penal Code, provides inadequate guidance for modern reproductive techniques including in vitro fertilization (IVF), surrogacy, and advanced contraceptive methods. The work raises awareness among stakeholders about the dangers inherent in unregulated access to various contraceptive methods and assisted reproductive techniques witnessed in urban centers in Nigeria today. Nigeria urgently requires comprehensive reproductive health legislation to address the legal, ethical, and cultural implications of emerging reproductive technologies and protect citizens' reproductive rights while maintaining social order.
